Article 1 - Purpose

These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between Fololo Beauty Paris ("the Brand") and any natural person acting as a consumer ("the Customer") wishing to make a purchase via the official website. www.fololobeauty.fr/ ("the Site").

The customer is invited to read these terms and conditions carefully before placing an order. Validation of an order implies full and unreserved acceptance of these GTC.

Article 3 - Pre-contractual information

In accordance with Articles L.111-1 et seq. of the French Consumer Code, Fololo Beauty Paris undertakes to provide the Customer, in a legible and comprehensible manner, prior to any final order, with the information necessary to enable the Customer to make an informed decision.

This information includes :

• The essential characteristics of the products offered for sale (composition, benefits, precautions for use, application advice);
• The total price of the products, including all taxes and charges (delivery charges, additional charges for certain payment methods, etc.);
• Terms of payment, delivery, order fulfillment and any delivery restrictions;
• The right of withdrawal and how to exercise it;
• Applicable legal warranties and after-sales service conditions;
• Brand identity, postal address, telephone number and e-mail address;
• Period of validity of the offer and price;
• The possibility of recourse to a mediator in the event of a dispute.

This information is accessible at all times on the Site and is recapitulated before the final validation of the order by the Customer.

Article 4 - Orders

4.1 Ordering process
The Customer selects the products presented on the Site, adds them to the basket, checks the details of his/her order and may correct any errors before validation. The order is finalized when the Customer clicks on "Confirm order" and proceeds to payment.

4.2 Order confirmation
A confirmation e-mail will be sent to the Customer, including a summary of the order, products, prices and delivery times. The order becomes final once payment has been confirmed.

4.3 Product availability
Product offers are valid as long as they are visible on the Site, while stocks last. In the event of unavailability after an order has been placed, the Customer will be informed by e-mail as soon as possible.

4.4 Refusal or cancellation of an order
Fololo Beauty Paris reserves the right to refuse or cancel any order for legitimate reasons, particularly in the case of payment problems, suspected fraud, or previous disputes.

Article 5 - Prices and payment terms

Prices shown are in euros, inclusive of all taxes, and exclude delivery charges. La Marque reserves the right to modify its prices at any time. Products are invoiced on the basis of the prices in force at the time the order is validated.

Payment is due in full when the order is placed. Payment may be made by credit card or any other secure method available on the Site. In the event of refusal by the payment center, the order will be automatically cancelled.

Article 6 - Delivery

6.1 Service areas
Fololo Beauty delivers to mainland France, including Corsica and Monaco, as well as to French overseas departments and territories, the European Union, North America, Asia and Oceania.

6.2 Delivery methods and costs
Delivery methods (standard, express, point relais, with signature) are indicated at the time of order. Charges are calculated according to weight, volume and destination. Delivery is free for orders over €60 in mainland France.

6.3 Deadlines
Delivery times vary according to destination:

• Metropolitan France: 3 to 5 working days ;
• DOM-TOM / Europe: 5 to 10 working days ;

• International: up to 15 working days.

If the indicative delivery times are significantly exceeded, the customer is invited to contact customer service. If, after verification, the delay is confirmed and is not due to force majeure, an appropriate solution will be proposed, up to and including cancellation of the order and full reimbursement.

6.4 Receiving parcels
It is the Customer's responsibility to check the condition of the package upon receipt. In case of anomaly (damaged parcel, missing or broken product), he must inform the carrier and Fololo Beauty Paris within 3 days, with supporting evidence (photos).

6.5 Undelivered / lost parcels
In the event of non-receipt of an order within the estimated delivery time, the Customer is invited to contact Fololo Beauty Paris Customer Service. An investigation may then be opened with the carrier in order to locate the package. If, at the end of this investigation, the package is considered lost, Fololo Beauty Paris will proceed, according to the Customer's choice, with either a free return of the order or a full refund. No additional compensation may be claimed.

Article 7 - Right of withdrawal

In accordance with articles L.221-18 to L.221-28 of the French Consumer Code, customers have 14 calendar days from the date of receipt of their order to exercise their right of withdrawal, without having to justify their decision or pay any penalties.

However, in accordance with article L.221-28 of the French Consumer Code, this right cannot be exercised for products that have been unsealed, opened or used, if they cannot be returned for reasons of hygiene or health protection.

Customers wishing to exercise their right of withdrawal must notify their decision clearly, by e-mail to contact@fololobeautyparis.com or using the withdrawal form provided in the appendix.

Article 8 - Returns and refunds

Products must be returned to the Brand in their original, unused condition, complete (packaging, accessories, instructions, etc.), at the Customer's exclusive expense, within a reasonable time and no later than 14 days following communication of the Customer's decision to withdraw.

All returns must be requested in advance from customer service. Products returned without authorization will not be accepted. The customer is invited to use a delivery method with tracking and proof of deposit.

Reimbursement will be made within 14 days from the date Fololo Beauty Paris is informed of the Customer's decision to cancel, subject to actual receipt of the products or proof of their return. Refunds will be made according to the original method of payment used by the Customer, unless expressly agreed otherwise by the Customer.

Return shipping costs are at the Customer's expense, unless Fololo Beauty Paris has made an error or the product received is not in conformity.

Article 9 - Legal warranties

In accordance with the provisions of Articles L.217-3 to L.217-17 of the French Consumer Code and Articles 1641 to 1649 of the French Civil Code, the products marketed by Fololo Beauty Paris are covered by legal warranties of conformity and warranties against hidden defects.

In the event of a lack of conformity or latent defect rendering the product unfit for its intended use, the Customer is invited to contact Fololo Beauty Paris Customer Service at contact@fololobeautyparis.com. The request must be accompanied by proof of purchase, a precise description of the defect found, as well as any useful evidence (photographs, batch number, etc.).

After analysis of the file and if the defect is confirmed, Fololo Beauty Paris will propose, according to the case, an exchange of the product or a refund. No returns will be accepted without prior authorization.

Due to the nature of cosmetic products, only unopened, unused products stored under conditions that comply with those indicated on the packaging will be eligible for the guarantee, except in the case of a proven defect attributable to the Brand.

The provisions of the present clause do not deprive the Customer of the benefit of the legal rights recognized by the legislation in force.

Article 10 - Intellectual property

Le site www.fololobeauty.fr/ as well as all its contents (including, but not limited to, texts, visuals, illustrations, photographs, videos, graphics, logos, graphic charters, icons, sounds, domain names, databases, underlying technologies, source codes, as well as the products themselves and their packaging) are protected by current intellectual property laws, in particular copyright, trademark law, and design and model law.

These elements are the exclusive property of Fololo Beauty Paris or its duly authorized partners. No intellectual property rights are granted to the Customer or to any user of the Site. Any reproduction, representation, adaptation, distribution, modification, translation, in whole or in part, in any form whatsoever, for commercial or non-commercial purposes, without the prior written consent of Fololo Beauty Paris is strictly prohibited.

The unauthorized use of any content of the Site or the Brand may constitute an infringement, punishable by articles L.335-2 et seq. of the French Intellectual Property Code, and may engage the civil and/or criminal liability of its author.

The Customer agrees to respect the intellectual property rights of Fololo Beauty Paris and not to damage its reputation or brand image.

Article 11 - Personal data

In order to manage orders, deliveries, customer service and commercial follow-up, Fololo Beauty Paris collects and processes personal data concerning the Customer.

This processing is carried out in compliance with current legislation, in particular the General Data Protection Regulation (RGPD).

For more information on the nature of the data collected, its purpose, how long it is kept, and the rights available to the Customer (access, rectification, deletion, opposition...), the latter is invited to consult the Privacy Policy available on the Site at the following address: www.fololobeauty.fr/politique-confidentialite

Article 12 - Customer service - Complaints - Mediation

If you have any questions or complaints, please contact customer service at contact@fololobeautyparis.com. In the event of an unresolved dispute, the customer may have recourse to a consumer mediator, in accordance with article L.612-1 of the French Consumer Code.

Article 13 - Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by French law, regardless of the Customer's country of delivery or residence.

In the event of any dispute relating to their validity, interpretation, performance or termination, and in the absence of a prior amicable solution, the French courts shall have sole jurisdiction, even in the event of multiple defendants or third-party claims.

However, the Customer is informed that he may have recourse to a conventional mediation procedure or to any other alternative dispute resolution method, in particular via the European online dispute resolution platform accessible at the following address : https://ec.europa.eu/consumers/odr
